Terms of service

These terms are an agreement between you and Christopher Ross, operating as Vortops ("Vortops", "we", "us"). They apply when you use the Vortops website, create an account, set up a project, use the sandbox, or use credits through a product built on Vortops. By creating an account or using the service you agree to them. If you use Vortops for an organisation, you confirm you can bind it.

The service

Vortops provides an account, a credit balance and access to AI models so that the products you build, such as plugins, apps, games and web tools, and the Vortops sandbox can use AI models. We may add, change or remove features and models. If we remove something you have paid for, we will give notice and, where reasonable, offer a replacement or a refund of the related unused credits.

Your account

  • You must be an adult and able to enter a contract where you live.
  • Give accurate information and keep your sign-in email secure. You are responsible for what happens under your account.
  • Each project has its own keys. Keep keys private. Tell us promptly if one leaks, and replace it from your account.
  • We may suspend or close accounts that break these terms or the acceptable use policy.

Credits

Credits are the unit used to pay for tasks. The full rules, including free credits, rollover and refunds, are in the credits and refunds policy, which forms part of these terms. In summary: credits do not expire, they have no cash value outside a refund we owe you, and they cannot be transferred to another account without our agreement.

Payment

  • Payments are processed by Stripe. Prices are shown in US dollars before you pay and exclude taxes unless stated. We add the taxes the law requires.
  • Subscriptions renew automatically until you cancel. You can cancel at any time from your account. Cancelling stops future charges; credits already granted stay on your account.
  • Metered accounts are billed in arrears for usage, on the terms agreed when the account is set up, including any spend limit. Invoices are due on the date shown.
  • If a payment fails, we may pause the paid features until it is fixed.

Your content and AI output

You keep your rights in the content you send to Vortops ("inputs") and, as between you and us, in the results produced from it ("outputs"), to the extent the law allows. You give us permission to process inputs only as needed to deliver outputs and run the service. You promise you have the right to send the inputs you send.

AI output can be wrong, incomplete, biased or similar to other output. It is not professional advice. You are responsible for reviewing output before you rely on it or publish it, for example by checking suggested alt text describes the image. Some models carry their own licence terms or restrictions. We identify these where you choose the model, and you must follow them.

Acceptable use

You must follow the acceptable use policy. We may limit or block requests that break it, and we may apply rate limits to protect the service.

Privacy

Our privacy policy explains how we handle personal information.

Availability and changes

We work to keep Vortops available, but we do not promise it will be uninterrupted or error free. Models and providers depend on third parties and can change or fail. Plugins, themes and apps that rely on Vortops should handle the service being unavailable.

Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.

Ending the agreement

You can stop using Vortops and close your account at any time. We can suspend or end your account for a serious or repeated breach, with notice where we reasonably can. If we end your account without a breach on your part, we will refund the unused portion of credits you paid for. Sections that by their nature should continue, such as liability limits, will continue.

Changes to these terms

We may update these terms. For changes that matter, we will tell account holders by email at least 30 days before they take effect. Using the service after that means you accept the new terms; if you do not, you can close your account and request a refund of unused paid credits.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction, except where consumer protection law gives you the right to go to court where you live.
